Terms of Service

KrakuMail provides private email hosting services from servers located in Iceland. The service includes email storage, sending, receiving, and access via IMAP, SMTP, and webmail interfaces. KrakuMail is operated as a privacy-first email service built on open-source infrastructure.

• You must be at least 16 years of age to use KrakuMail
• You must provide accurate information when creating your account
• You are responsible for maintaining the security of your account credentials
• One person or legal entity per account unless on a Business plan with team management

You agree not to use KrakuMail to:

• Send unsolicited bulk email (spam) of any kind
• Distribute malware, phishing attempts, or other malicious content
• Harass, threaten, or abuse other individuals
• Impersonate any person or entity
• Violate any applicable law, regulation, or third-party rights
• Engage in activities that disrupt, damage, or impair the service
• Use the service for unlawful mass surveillance or data collection
• Resell or redistribute access to the service without written authorization

Free tier accounts (Hrafn plan) are provided on a limited, invitation-only basis. KrakuMail reserves the right to:

• Limit the number of free tier accounts available at any time
• Modify the features, storage limits, or capabilities of the free tier
• Discontinue the free tier entirely with 30 days' notice to affected users
• Require existing free tier users to upgrade to a paid plan for continued access

Free tier accounts that remain inactive (no login) for more than 180 consecutive days may be subject to deletion after a 30-day warning notice sent to the registered email address.

• Paid plans are billed monthly at the rates displayed at the time of subscription
• Payment is processed by our payment provider; KrakuMail does not store payment card details
• You may cancel your subscription at any time; service continues until the end of the billing period
• Refunds are not provided for partial billing periods
• We reserve the right to change pricing with 60 days' advance notice; existing subscribers are grandfathered at their current rate for 12 months after any price increase

KrakuMail may suspend or terminate your account if:

• You violate these Terms of Service, particularly the acceptable use provisions
• Your account is used for illegal activity under Icelandic or international law
• We receive a valid Icelandic court order requiring account suspension
• Your paid subscription lapses and is not renewed within 30 days

Upon termination, your mailbox and account data will undergo our secure deletion process. This action is irreversible. If you are on a paid plan and wish to preserve your data, you should export it via IMAP before your subscription ends.

• All KrakuMail data is stored on servers located in Iceland
• Your data is subject to Icelandic law, including the Icelandic Data Protection Act (Act No. 90/2018)
• KrakuMail complies with the EU General Data Protection Regulation (GDPR)
• We do not transfer user data outside of Iceland except as required for email delivery to external recipients
• We do not comply with foreign intelligence requests or surveillance orders from non-Icelandic jurisdictions

Your privacy is fundamental to our service. Our data handling practices are described in detail in our Privacy Policy, which forms part of these Terms. Key commitments:

• We do not read, scan, or analyze the content of your emails
• We do not sell or share user data with third parties
• Deleted data is securely overwritten using NIST SP 800-88 compliant methods on HDD storage
• Per-user mail-crypt encryption protects your data at rest

• KrakuMail aims for 99.9% uptime but does not guarantee uninterrupted service
• Planned maintenance will be communicated at least 48 hours in advance when possible
• Business plan users with SLA guarantees are subject to separate SLA terms
• We are not liable for service disruptions caused by circumstances beyond our control, including but not limited to natural disasters, infrastructure failures, or regulatory actions

To the maximum extent permitted by Icelandic law:

• KrakuMail is provided "as is" without warranties of any kind, express or implied
• KrakuMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim arising from the service shall not exceed the amount you paid for the service in the 12 months preceding the claim
• KrakuMail is not liable for data loss resulting from account termination initiated by the user or due to violation of these terms

• We may update these terms from time to time
• Material changes will be communicated to registered users at least 30 days in advance via email
• Continued use of the service after changes take effect constitutes acceptance of the revised terms
• Previous versions of these terms will remain publicly accessible

These terms are governed by and construed in accordance with the laws of Iceland. Any disputes arising from these terms or the use of KrakuMail shall be subject to the exclusive jurisdiction of the courts of Reykjavík, Iceland.
